1760 - Benjamin Bodge of Durham cordwainer brought suit against David Greer
of Barrington for 18# in damages because of a promissory note not repaid. The

Signed by mark (a "+" sign) David Greer. Wit: H? Messirve? & Hannah Willy
On 4 Nov 1760 the Sheriff of the Province of NH was ordered to attatch the
goods or estate of David Greer of Barrington, husbandman, to the value of 18#,
or for the want thereof, to take him into custody and present him to the Court
of Common Pleas at Portsmouth on the first Tuesday in December next, to answer
to Benjamin Bodge of Durham in the Province aforesaid, cordwainer, in an action
of the case for that whereas the Def't on the 20th day of November 1748 at
Durham aforesaid by a note in writing by him signed, there & then promised to
pay unto the Pla't thirty five pounds & twelve shillings on demand old tenor &
after date interest at fifteen percent till paid, being for value received &
yet the Def't tho often requested hath not paid the same, to the damage of the
said Benjamin as he saith. The sum of Eighteen Pounds, which shall then and
there be made to appear, with other due damages; and have you there this writ,
with your Doings therein. Witness Daniel Warner Esq; at Portsmouth, the 4th
Day of November the the 34th Yearof Our Reign. AD 1760. Sig: H Wentworth
Clerk.
On the back of the writ is an endorsement, dated 17 Nov 1760, which stated
that "by virtue of the within writ I attached a chear of the Def't valued three
shillings & left a summons at his place of abode" signed: James Kielle under
She'r [Records of the Court of Common Pleas, NH State Archives, File #521].
On 11 Mar 1761 the Sheriff was ordered to recover the judgement against
David Greer as awarded by the Court of Common Pleas, i.e., nine pounds ten
shillings old tenor damages & five pounds fifteen shillings the like money cost
of suit, plus the Sheriff's fees. There is no endorsement on the back of this
document, and apparently it was not acted upon because another copy with the
same text is included in the file, except that the second document is dated 4
Jun 1761. The second writ is endorsed on the back "Recieved in full of the
within execution per me Sam'el Daniel Deputy Sheriff" and "Receved the full of
the within execution of Samuel Daniel Dp't She'r James Kielle attorney for sd
Pla't [Records of the Court of Common Pleas, NH State Archives, File #521].

1762 Apr 1 - from David Greear (Greer) of Barrington to Roger Dugin (Durgin)

1762 Aug - Joseph Sias of Durham gentleman filed suit for 40# damages
against David Greer of Barrington yeoman because of an unpaid promissory note
for 78# 3s of which only 3# 15s had been paid. The original note is in the
file and read: "Durham Nov'r 14th 1759 I promise to pay to Joseph Sias or his
order Seventy Eight pounds three Shillings old Tenor on Demand with Entrest at
fifteen per Cent untill paid if being for Value Recei'd per me. Sig: David
Greer by mark (an "x"). Wit: ... McCuth..
On 2 Aug 1762 the Sheriff was ordered to attach the property of David Greer
of Barrington yeoman to the value of 40#, or incarcerate him, to assure his
appearance at the Court of Common Pleas in Portsmouth on the first Tuesday in
September.
The file appears to be defective in that there is an endorsement on the back
of one of the papers indicating that Deputy Sheriff Samuel Daniel had arrested
David Greer and taken Nicholas Doody and Paul Pinkham for bail on 13 Jul 1762.
Perhaps the date is simply in error.
The case was heard by the Court on 7 Sep 1762. Greer failing to appear
judgement went to Sias for 28# 14s 6p damages & 7# 7s costs. Greer appeared
later at that term of the Court and moved an appeal to the Superior Court which
was granted, but the final outcom is not indicated [Records of the Court of
Common Pleas, NH State Archives, File #28026].
1762 Aug - Joseph Co__ of Barrington husbandman filed suit for damages of
47# against David Greer of Barrington husbandman because Greer had failed to
pay a promissory note. The note was dated 4 Jan 1762 at Barrington, and was
for 47# old tenor with interest at fifteen percent.
On 12 Aug 1762 the Sheriff was ordered to attach the property of Greer to
the value of 47#, or the incarcerate him, to assure his appearance at the Court
of Common Pleas on the first Tuesday in September. An endorsement on the back
of the document shows that on 24 Aug 1762 a chair valued at 5s was taken from
Greer by Deputy Sheriff Samuel Daniel who left a summons at Greer's abode. The
finald disposition of the case is not indicated [Records of the Court of Common
Pleas, NH State Archives, File #2129].
1762 Nov - Samuel Hanson of Barrington husbandman filed suit against David
Greer of Barrington yeoman for 20# damages because of his failure to pay a
pronissory note made at Durham on 10 Sep 1762 whereby Greer promised to pay
Ichabod Denbo 40# old tenor. This note was subsequently assigned to Samuel
Hanson by Ichabod Denbo on 15 Oct 1762, and neither had been able to collect
the money due.
On (17?) Nov 1762 the Sheriff of NH was ordered to attach the goods or
estate of David Greer of Barrington yeoman to the value of 20#, or lacking that
to incarcerate him, and see that he appeared at the Court of Common Pleas in
Portsmouth on the first Tuesday in December to answer to Samuel Hanson of
Barrington husbandman concerning the note described above.
The case was heard on 7 Dec 1762, and Greer failing to appear, judgement was
given to Hanson by default in the amount of 10# new tenor damages & 7# 12s
costs. Greer subsequently appeared later in the term of the court and
requested an appear to the Superior Court which was granted for the 2nd Tuesday
of May next. An endorsement indicates that Greer did not prosecute the appeal,
and that damages & costs totaling 18# 1s were awarded to Hanson [Records of the
Court of Common Pleas, NH State Archives, File #13232].
1763 Jul - Paul Pinkham of Durham yeoman filed suit for 50# damages against
David Grear of Barrington husbandman alleging that on 21 Mar 1763 at Durham
Greer signed a promissory note to Pinkham for 104# old tenor on demand with
fifteen percent interest, but had failed to pay it.
On 30 Jul 1763 the Sheriff was ordered to attach the goods of David Greer to
the value of 50#, or to incarcerate him, to assure his appearance the the Court
of Common Pleas on the first Tuesday in September. An endoresement on the back
of the writ shows that Samuel Daniel Deputy Sheriff took a mare of Greer's with
a value of 5# on 13 Aug 1763. The final disposition of the case is not shown
[Records of the Court of Common Pleas, NH State Archives, File #1783].
1766 Apr 7 - "voted Jonathan Church not Relest David Greers Rate," "then voted
Jonathan Church Reconsidered David Greers Rate." [Barr Town Rec 1/419]. These
last few records make it appear that Greer sold his property and left the
juridiction in 1763 or soon after.MISCELANEOUS ITEMS:
